“You” or “Your” refers to you individually (i.e., the person who reads and is bound by these Terms) and, if you access this Site on behalf of a business or other legal entity, “you” or “your” refers collectively to both you and the entity you represent.

Unless otherwise governed by a separate contractual agreement between you and Mythri Smart Bazaar, these Terms apply to all users accessing our Website or App, irrespective of the method or medium of access (e.g., desktop, mobile, partner site integrations, etc.).

1. Website Use License

Subject to the terms and conditions stated herein, Mythri Smart Bazaar grants you a non-exclusive, non-transferable license to access and use this Website and the services offered herein strictly for your personal, individual, and non-commercial use. This includes browsing the website for information, exploring our programs, and availing yourself of the services provided by Mythri Smart Bazaar.

You acknowledge that this Terms of Use expressly provides you with the rights and licenses described herein, and such rights are limited to the scope expressly stated. Mythri Smart Bazaar reserves the right to modify, update, suspend, or discontinue any part or all of the services available on the Website at any time, with or without prior notice. Your continued use of the Website following such changes constitutes your acceptance of these modified Terms.

All rights not expressly granted to you under these Terms are reserved by Mythri Smart Bazaar and its licensors.

2. Conditions of Use

2.1 Access to this Website and its services is permitted only to individuals or entities who have reached the age of legal majority and are legally competent to enter into binding agreements under applicable laws. If you do not meet these criteria, please do not use the Website.

2.2 All content available on this Website, including but not limited to text, graphics, logos, images, icons, design elements, and software or plugins, is the property of Mythri Smart Bazaar or its content providers, and may be protected by copyright, trademark, and other applicable laws (“Proprietary Rights”). You agree not to remove or alter any copyright, trademark, or other proprietary notices or legal disclaimers.

2.3 You agree not to modify, publish, transmit, reverse-engineer, transfer, sell, create derivative works from, or exploit any of the content found on the Website or App, in whole or in part, for any commercial or unlawful purposes.

2.4 Mythri Smart Bazaar acts only as a facilitator and is not a party to any transaction between you and any third-party vendors, sellers, or service providers whose products or services may be listed on or linked to from our platform. We have no control over such third parties, their pricing, quality of products, services, or fulfillment. Therefore, Mythri Smart Bazaar disclaims any and all warranties and liabilities related to such third-party interactions.

2.5 As part of the registration or user interaction process, Mythri Smart Bazaar may collect personally identifiable information from you, including your full name, alternate email address, mobile number, postal address, demographic details (such as age, gender, occupation, and education), and browsing behavior on our Website. By using our Website or App, you hereby consent to the collection, use, and handling of such information in accordance with our Privacy Policy.

3. User Registration and Membership

3.1 Whether you are a casual visitor (“Visitor”), a user who registers for an account on our Website (“Registered User”), or a customer who subscribes to our premium services (“Member”), your use of the Website is governed by these Terms. (Registered Users and Members are collectively referred to as “Users”).

3.2 To access certain benefits such as cashback, rewards, or exclusive offers on Mythri Smart Bazaar, you must register as a Registered User or opt for a Membership Plan, if applicable. You are solely responsible for maintaining the confidentiality of your login credentials and for any activity conducted through your account. You agree not to share your account access and to comply with all applicable laws and guidelines during your use of the platform.

3.3 Mythri Smart Bazaar reserves the right to charge a registration or membership fee as part of the onboarding process. We may revise these fees at our discretion; however, any such changes will not affect existing Users until their current membership term ends and they choose to renew.

3.4 We reserve the right to update, modify, or terminate registration and membership terms at any time, with or without prior notice. Such changes will be reflected on the Website or App, and continued use of our services constitutes your agreement to the revised terms.

3.5 User Registration or Membership is non-transferable. You may not assign or share your account with another person. Mythri Smart Bazaar reserves the right to accept, decline, suspend, or cancel any registration or membership at its sole discretion at any time.

4. Earning Cashback

4.1 Users may earn cashback (“Cashback”) for eligible purchases made via Mythri Smart Bazaar. Cashback may be credited as fiat currency, reward points, or electronic coupons, depending on the format published by us. If local laws restrict the handling of digital rewards or electronic coupons in your region, you must comply with applicable regulations and limit your use of our service accordingly.

Cashback-related terms—including but not limited to eligibility, crediting timelines, redemption methods, and reversals—will be governed by applicable service-specific or transaction-specific conditions.

4.1.1 Cashback or rewards are credited after a successful Qualifying Transaction once the cashback is received from the partnered merchant. Users may redeem the rewards as money or gift vouchers. Cashback validity is subject to confirmation by the merchant. Mythri Smart Bazaar is not liable for any discrepancies or denials of cashback by merchant partners.

4.1.2 Only Registered Users or Members are eligible for cashback on qualifying purchases as indicated during checkout on our partner stores (online or offline).

4.1.3 No cashback will be granted for cancelled or refunded orders. Credited cashback may be reversed without notice in such cases.

4.1.4 Cashback offers are non-transferable and cannot be combined with other offers unless explicitly stated.

4.1.5 Cashback may initially appear as “pending” and will be marked “validated” once confirmed by the merchant, which may take up to 90 days. Cashback is void if the transaction is reversed, returned, or deemed invalid. Users are responsible for reporting returns affecting cashback.

4.2 Cashback eligibility varies by transaction type, merchant, and payment method. Net amounts (excluding delivery or handling fees) are used to calculate cashback. Users must review each merchant’s specific cashback policy carefully.

4.2.1 Cashback rates may vary for different users or membership levels.

4.2.2 Any misuse or fraudulent behavior can lead to cancellation of cashback and suspension or termination of the user account.

4.2.3 Cashback appears in your Mythri Smart Bazaar wallet. Please note this wallet is separate from any co-branded third-party wallets.

5. User Guidelines

5.1 We continually update and enhance our platform. Feedback you provide may be used by Mythri Smart Bazaar without restriction or compensation.

5.2 Users may only operate one account per mobile number. Multiple accounts for the same user are not permitted.

5.3 Accounts involved in fraud or providing false information may be suspended or terminated. Earned cashback and credits may be forfeited.

5.4 Users are advised to regularly check their accounts for accuracy. Errors must be reported within 30 days of the transaction date.

5.5 For cancellations, refunds, or returns, users must initiate requests via their accounts or contact our Help Desk for assistance.

5.6 We do not guarantee merchant claims. Users are advised to exercise due diligence when engaging with third-party sellers.

5.7 Mythri Smart Bazaar is not responsible for non-performance or contract breaches by merchants. We are a facilitator—not a party to sales transactions. Users should resolve product or service disputes with the respective merchant. We’ll support resolution by sharing relevant merchant contact information where available.

6. Modes of Availing Cashback

6.1 Online Shopping

Mythri Smart Bazaar provides a platform for Registered Users and Members to earn cashback through purchases made with participating merchants. Visitors can browse offers but must register to transact.

To earn cashback:

For offline transactions:

  • Users must visit and purchase through a participating merchant store
  • The transaction must be tracked and confirmed by the merchant
  • Cashback is credited once verified

Offline cashback requires successful validation through the Mythri Smart Bazaar App and may depend on user and merchant reporting.

6.2 Gift Vouchers

Users may:

  • Purchase gift vouchers
  • Redeem cashback for gift vouchers from partner merchants

Gift vouchers must be secured by the user. Mythri Smart Bazaar is not responsible for losses due to unauthorized access or misuse.

6.3 Deals & UPI Payments

We help users discover nearby offers and merchants. Users are responsible for validating transactions with merchants. Mythri Smart Bazaar will assist with complaints when feasible but does not accept liability for merchant misrepresentations or fulfillment issues.

UPI-based purchases must be confirmed by both parties to qualify for cashback.

7.INTELLECTUAL PROPERTY

All rights, title, and interest in and to the Mythri Smart Bazaar online platform (“Online Platform”), including all Intellectual Property rights arising out of it, are owned by or licensed to Mythri Smart Bazaar. Subject to your compliance with these Terms, Mythri Smart Bazaar grants you a non-exclusive, non-transferable, non-sub-licensable, royalty-free, revocable, and limited license to use the Online Platform in accordance with these Terms.

Except as expressly authorized by Mythri Smart Bazaar, you agree not to sell, license, distribute, copy, modify, publicly perform or display, transmit, publish, edit, adapt, create derivative works from, or otherwise make unauthorized use of any of the platform’s intellectual property. You do not acquire any rights or interest in the intellectual property, and your use shall be strictly in accordance with these Terms.

Users shall not reverse engineer or disassemble any part of the platform or its underlying systems.

Mythri Smart Bazaar may, from time to time, request feedback or suggestions. All such submissions will be considered voluntary, and Mythri Smart Bazaar may use them freely without acknowledgment, compensation, or restriction.

You represent and warrant that:

  • You shall use Mythri Smart Bazaar’s intellectual property only for lawful purposes and as outlined in these Terms;
  • You shall not modify, misuse, or combine the intellectual property with any other marks;
  • You shall not infringe, register, or attempt to register any mark that may conflict with Mythri Smart Bazaar’s rights;
  • You shall notify Mythri Smart Bazaar of any suspected infringement or misuse;
  • You shall provide assistance in enforcing Mythri Smart Bazaar’s rights when requested.

8.CONFIDENTIALITY

You agree to maintain the confidentiality of all non-public, proprietary, or sensitive information (“Confidential Information”) shared with you by Mythri Smart Bazaar. You shall protect it with the same level of care used for your own confidential information, and not disclose or use it except as necessary for authorized transactions.

Confidential Information does not include information that:

  1. Was already lawfully in your possession;
  2. Becomes public through no fault of yours;
  3. Is rightfully received from a third party without restriction;
  4. Is independently developed by you without using confidential information.

Mythri Smart Bazaar may disclose Confidential Information:

  • To its officers, employees, and affiliates;
  • To professional advisors;
  • Where required by law or court order.

9.COMMUNICATION POLICY

By using our services, you consent to receive notifications, updates, and promotional messages via SMS or email from Mythri Smart Bazaar. You may opt out of non-essential communications by adjusting your account settings or contacting our support team. SMS and email services are provided as a convenience and may be subject to technical inaccuracies or delays.

10.TERMINATION

Mythri Smart Bazaar reserves the right to suspend or terminate your account, access, or use of the Services at any time, without prior notice, for reasons including (but not limited to) violation of these Terms or inactivity. Termination may also be executed through authorized third-party issuers if applicable.

If your account is terminated, you must cease using all Services. Suspected fraudulent or illegal activities may be reported to authorities. Termination shall not affect any rights accrued by Mythri Smart Bazaar.

11.THIRD-PARTY SERVICES AND LINKS

Our platform may include links to third-party sites or services not operated by Mythri Smart Bazaar. We do not endorse or assume responsibility for any content, services, or practices of such third parties.

Users access such services at their own risk, and are solely responsible for reviewing and accepting the terms and privacy policies of those third-party platforms.

12.INDEMNITY

You agree to indemnify, defend, and hold harmless Mythri Smart Bazaar, its affiliates, employees, and partners from and against any and all losses, damages, claims, liabilities, costs, and expenses arising out of:

  • Your misuse of the platform;
  • Your breach of any of these Terms;
  • Any unlawful or negligent act by you or someone using your account.

13.WARRANTY DISCLAIMER

You acknowledge that you use the platform at your sole risk. All services are provided “as is” and “as available” without warranties of any kind, whether express or implied.

Mythri Smart Bazaar does not guarantee:

  • Uninterrupted or error-free service;
  • That the Services will meet your expectations;
  • Correction of any defects.

We do not offer any services regulated by the Reserve Bank of India or any other financial regulatory body.

14.LIMITATION OF LIABILITY

Under no circumstances shall Mythri Smart Bazaar, its affiliates, or partners be liable for any indirect, incidental, consequential, punitive, or special damages, including lost profits or data, arising out of your use or inability to use the platform.

15.FORCE MAJEURE

Mythri Smart Bazaar shall not be held liable for any delay or failure to perform due to events beyond its control, including but not limited to:

  • Natural disasters, pandemics, or epidemics;
  • Government actions or legal restrictions;
  • Internet outages, hacking, or service attacks;
  • Labor disputes or other force majeure events.

Performance obligations will be suspended during the duration of such events.

16.SEVERABILITY

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue to be valid and enforceable. A revised clause reflecting the original intent will replace the invalid portion.

17.ASSIGNMENT AND WAIVER

You may not transfer or assign your rights or obligations under these Terms. Mythri Smart Bazaar may assign its rights without your consent. Failure to enforce any provision shall not constitute a waiver of that or any other right.

18.NOTICES

All legal notices from Mythri Smart Bazaar may be sent via email or physical address you provide. You must send legal notices to us only via registered post or courier at:

19.COMMUNICATION CONSENT

By agreeing to these Terms, you also consent to receive future communication from Mythri Smart Bazaar via WhatsApp, SMS, or other electronic messaging services, for service updates, transaction alerts, offers, or other business communications.

20.GOVERNING LAW AND DISPUTE RESOLUTION

These Terms and any policies or agreements referenced herein shall be governed by and construed in accordance with the laws of India.

The Parties agree to attempt in good faith to resolve any dispute, controversy, or claim arising out of or relating to these Terms or any associated policies within thirty (30) days of such dispute being raised.

If the dispute cannot be resolved within that time frame, the Parties agree that the dispute shall be submitted to binding arbitration in accordance with the Arbitration and Conciliation Act, 1996. The arbitration proceedings shall be conducted in English, and the venue of arbitration shall be Mumbai, Maharashtra. The decision of the arbitrator shall be final and binding on both Parties.

21.CANCELLATION POLICY

Upon receiving:

  1. The User’s confirmed purchase order, and
  2. Confirmation of successful payment from the User through the prescribed payment channel,

Mythri Smart Bazaar will:

  • Either issue a Sale Confirmation to the User, or
  • Reject the User’s purchase request if any validation or regulatory criteria are not met.

Note: Once a Sale Confirmation is issued by Mythri Smart Bazaar or its associated partner entities, the order is final and cannot be cancelled, revoked, or modified by the User for any reason.

Mythri Smart Bazaar may act as a technology-enabled platform/intermediary, as defined under the Information Technology Act, 2000, and the rules thereunder. In such cases:

  • The ownership of the product or service remains with the respective merchant or provider until delivery is complete.
  • Mythri Smart Bazaar does not assume title, liability, or responsibility for such products or services offered by third-party sellers, unless explicitly stated.

22. Delivery of Prescribed Drug Products

You acknowledge that Mythri Smart Bazaar is not a pharmacy and does not recommend or endorse any particular pharmacies for processing prescriptions. Mythri Smart Bazaar merely displays and routes Users to online and offline stores where prescribed drug products may be ordered. The selection of a drugstore to fill the prescription is solely your responsibility and discretion. Mythri Smart Bazaar makes no guarantees regarding the quality of the prescribed medication or the services offered by any pharmacy. You are advised to contact the pharmacist directly if you face any issues.

You agree that, upon delivery of prescribed drug products, the recipient will present valid government-issued identification to the Merchant delivering the items, confirming their legal age, and if the recipient is not you, they will disclose their relationship to you. You further affirm that any prescribed medication delivered through the Services is not intended for resale or for provision to anyone other than the person to whom it is legally prescribed.

You also acknowledge that Mythri Smart Bazaar does not provide any medical advice, diagnosis, or treatment, and no physician-patient or pharmacy-patient relationship exists between you and Mythri Smart Bazaar as a result of using our platform. We strongly encourage you to consult with a qualified healthcare provider or pharmacist for any health-related concerns or questions.

By using the Mythri Smart Bazaar Website or App to order a prescribed drug product for a child or another household member, you confirm that your intent is solely to deliver the medication to its rightful user for personal use and not for your own consumption or distribution.

23. Processing Payment

8.1 While availing any payment methods available on the Mythri Smart Bazaar Website or App, or while using the Mythri Smart Bazaar payment system, we shall not be held responsible or assume any liability, whatsoever, in respect of any loss or damage arising directly or indirectly to you due to:

23.1.1 Lack of authorization for any transactions, or
23.1.2 Exceeding the transaction limit as mutually agreed between you and your issuing bank, or
23.1.3 Any payment issues arising out of the transaction, or
23.1.4 Decline of transaction for any reason, or
23.1.5 Failed transaction due to technical issues on the part of the User or the device used.

24. Cancellation Policy

24.1 You may cancel your order, either partially or fully, at any time before the cut-off period defined by the respective Merchant with whom you have placed the order. In such cases, the Merchant’s cancellation and refund policies shall govern the refund and cancellation process.

24.2 No cashback shall be eligible for orders that are canceled. Any cashback already credited to your Mythri Smart Bazaar account may be reversed by Mythri Smart Bazaar without notice. For any order that is canceled or refunded (whether partially or fully), the associated cashback (if any) shall be adjusted or revoked accordingly.

24.3 All returns, exchanges, and cancellations are subject to the manufacturer’s warranties and the invoice terms and conditions set forth by the respective Merchant.

25. Third-party Products and Content

Our services may include access to third-party products, services, and content (collectively, “Third-party Content”). Mythri Smart Bazaar does not endorse or assume any responsibility for Third-party Content, and your interactions with any third parties through our platform are solely between you and such third parties. We make no representations or warranties regarding the accuracy, reliability, or completeness of such Third-party Content.

Your use of Third-party Content is subject to the terms and privacy policies of the respective third parties, and you agree that Mythri Smart Bazaar is not responsible for any loss or damage incurred as a result of such use.

26. Termination / Cancellation of Membership by Mythri Smart Bazaar

26.1 Membership to Mythri Smart Bazaar, once purchased, is non-cancellable by the User.

26.2 Mythri Smart Bazaar reserves the right to cancel your membership at any time, with or without prior notice. In such cases, a credit note or prorated refund (based on the number of unused full months of membership) may be issued. However, if your account is terminated due to conduct that violates these Terms of Use, applicable laws, or involves fraud, misuse, or actions detrimental to the platform or its users, no refund shall be granted.

26.3 If there is reasonable suspicion of fraudulent, dishonest, or abusive behavior, Mythri Smart Bazaar may suspend or terminate your account. This may also result in the cancellation of purchases (e.g., store credits or vouchers) and the forfeiture of any rewards or cashback benefits accrued. Any failure by us to enforce our rights strictly shall not be considered a waiver of those rights.

27. Disclaimer

You acknowledge that by accessing and using the Mythri Smart Bazaar Website, App, or any associated services, you do so at your own risk. You are solely responsible for making informed and prudent decisions before placing any orders or transacting through the platform.

Mythri Smart Bazaar shall not be liable for any warranties, guarantees, or representations regarding the quality, suitability, or functionality of any products or services, except for limited warranties explicitly provided by the original manufacturer or supplier. All other responsibilities and liabilities are expressly disclaimed.

28. Ownership of Rights

All rights, including copyrights, trademarks, and all other intellectual property rights in the Website, App, and chatbot interface, are owned by or licensed to Mythri Smart Bazaar.

Any use of the content—whether in whole or in part—beyond personal, non-commercial purposes is strictly prohibited without prior written permission from Mythri Smart Bazaar. You may not modify, republish, transmit, or distribute any material from this platform for any commercial use.

29. Indemnification

29.1 You agree to defend, indemnify, and hold harmless Mythri Smart Bazaar, its officers, directors, employees, agents, affiliates, merchants, and retail partners (each, an “Indemnified Party”) from and against any claims, liabilities, losses, damages, costs, or expenses (including legal fees) arising out of:

  • your breach of these Terms;
  • your use of the Services in a manner not authorized by us; or
  • your violation of any applicable laws or rights of third parties.

29.2 You expressly release Mythri Smart Bazaar and its representatives from any responsibility, liability, or consequences arising from the conduct, actions, or inactions of manufacturers, brand owners, or service providers for any products or services purchased through the platform. You waive any claims under applicable law or contract arising in this regard.

29.3 This indemnification clause shall survive the expiration or termination of these Terms of Use.
